9th Circuit Court of Appeals Affirms Lower Court Refusal to Compel Employees to Arbitrate

MHN Government Services, Inc. v. Zaborowski is a decision from the Ninth U.S. Circuit Court of Appeals in which the lower court refused to compel arbitration. The plaintiffs in the case claimed they were misclassified as independent contractors instead of employees. The employees were required to sign an arbitration agreement which they argued was unconscionable under California law. The lower court found provisions of the arbitration agreement were unconscionable but refused to strike the offending provisions from the agreement, thereby negating the obligation to arbitrate. 601 Fed.
